RESIDENTS IN THE UNITED KINGDOM, FRANCE, CANADA, UNITED ARAB EMIRATES, JAPAN, UNITED STATES OF AMERICA, MEXICO, ARGENTINA, SAUDI ARABIA, KUWAIT, QATAR, GERMANY, AUSTRIA, SWITZERLAND, RUSSIA, SINGAPORE, PHILLIPINES, THAILAND, AUSTRALIA, CHINA, HONG KONG, BRAZIL, KOREA, PORTUGAL & SPAIN.

  1. The “BURBERRY HERO” digital game (the “GAME”), is a game of skill administered by COTY S.A.S. a French société par actions simplifiée with its registered offices at 14, rue du Quatre Septembre, 75002 Paris, FRANCE, registered with the Register of commerce and companies of Paris, under number 394 710 552 (“COTY/WE/US”). By participating in the Game, you accept and agree to be bound by these terms and conditions, and by the decisions of Coty, which are final and binding in all matters relating to the Game. The Game is void where prohibited by law.
  2. Game Description: The Game is free-to-enter, and available :
  • On the BURBERRY BEAUTY’s and participating retailer’s websites (the “WEBSITE VERSION”);
  • On the BURBERRY BEAUTY’s and participating retailers’ social media account (Instagram, Facebook, YouTube) (the “SOCIAL MEDIA VERSION”);
  • In-store by the participating retailers (the “IN-STORE VERSION”). (Together the “GAME VERSIONS”). [The award of prizes is determined solely by the participant’s skill and judgment in playing the Game and achieving certain distances, as outline below.
  1. Game Period: The Game will be available from 08/02/2021 01:00:00 British Standard Time to 01/31/2022 23:59:00 British Standard Time (“GAME PERIOD”). Play conducted after the end of the Game Period will not be valid, and prizes will no longer be available.
  2. No Purchase Necessary: Entry into the Game is free and no purchase is necessary to enter or receive a prize.
  3. Eligibility:
  • Requirements: You will need to have access to an internet-connected device operating at least iOS 10.0 or Android 4.2.
  • Residency: You must be a resident of the THE UNITED KINGDOM, FRANCE, CANADA, UNITED ARAB EMIRATES, JAPAN, UNITED STATES OF AMERICA, MEXICO, ARGENTINA, SAUDI ARABIA, KUWAIT, QATAR, GERMANY, AUSTRIA, SWITZERLAND, RUSSIA, SINGAPORE, PHILLIPINES, THAILAND, AUSTRALIA, CHINA, HONG KONG, BRAZIL, KOREA, PORTUGAL & SPAIN  (each an “ELIGIBLE COUNTRY”).
  • Minimum Age Restrictions:
  • If you are a resident of THE UNITED KINGDOM, FRANCE, CANADA, JAPAN, UNITED STATES OF AMERICA, MEXICO, ARGENTINA, SAUDI ARABIA, GERMANY, AUSTRIA, SWITZERLAND, RUSSIA, SINGAPORE, PHILLIPINES, THAILAND, AUSTRALIA, CHINA, BRAZIL, KOREA, PORTUGAL or SPAIN  you must be over the age of 16 to access the game.
  • If you are a resident of HONG KONG, QATAR, KUWAIT or UNITED ARAB EMIRATES you must be over the age of majority in your legal place of residence to access the game.
  • Excluded Individuals: Employees, officers, directors, contractors, agents or representatives of Coty or any Burberry group company (collectively, the “EXCLUDED INDIVIDUALS”), or any members of the same household of the Excluded Individuals, or any other persons with whom the Excluded Individuals reside are not eligible to win any physical prizes.

By entering the Game, you confirm that you are eligible to do so and to claim any prize you may win. Coty reserves the right to disqualify any participant who does not satisfy the eligibility requirements and any such participant shall have no claim to any prize in connection with the Game.

        Prizes

  1. There are different prizes to be won when reaching certain distances and depending upon the Eligible Country you are in as set out below. If you reach specified distances in the Game and depending on the Game Version and which Eligible Country you are in, you may be eligible to receive a physical prize such as a Free Sample or a Free Pouch according to the criteria set out below.  The physical prize has no retail value and there are a limited number of these physical prizes, depending on the limits of available product stocks of the participating retailers. Once the physical prizes are no longer available, the Participants are no longer eligible to receive one. Each Participant may only win one physical prize.  There are also digital prizes (including Bronze Medal, Silver Medal, Gold Medal & Black Obsidian Medal) none of which has any retail value.

  1. There is no cash or credit alternative to any of the prizes in this Game. We reserve the right to provide alternative prizes of equal or greater value if the stated prizes are no longer available. Prizes are non-transferable, not for resale, non-refundable and non-changeable. ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND WE HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PURPOSE AND NON-INFRINGEMENT.
  2. No responsibility is accepted by us for matters beyond our reasonable control, including without limitation system errors or other issues that may result in disrupted, lost, delayed or not received entries. No refund or replacement prize will apply for any delays or cancellations caused by such matters. We accept no responsibility for any incomplete or inaccurate entries received or for system errors or other issues that may result in disrupted, lost, delayed or not received entries or winner notifications. Winners are responsible for any tax liability (including any customs duties if applicable) accruing as a result of this Game.
  3. By entering the Game, to the fullest extent permitted by law, you agree to release and hold harmless us, our subsidiaries, affiliates, agents, representatives, and affiliated third parties (collectively, the “RELEASED PARTIES”) from any and all claims, liability, loss or damage whatsoever arising with respect to the Game or the awarding, receipt, possession and/or use or misuse of any prize and further acknowledges that none of the Released Parties have made nor are responsible or liable for any warranty, representation or guarantee of a particular purpose. To the fullest extent permitted by law, we will not be liable for any loss or damage arising from the playing of the Game or from the enjoyment of any Prizes that may be won.
  4. You may also be disqualified if we learn that you have disparaged Burberry or Coty, or if you do not comply with these terms and conditions.
  5. We can suspend or change the terms of the Game at any time without notice if required by law. We reserve the right to cancel, suspend, terminate or modify the Game in our sole discretion, including but not limited to, if it is not capable of being completed as planned for any reason, due to infection by computer viruses or bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort beyond our reasonable control, which corrupts or impairs the administration, security, fairness or proper play of the Game.
  6. Unless otherwise stated in these terms and conditions, the invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision. Unless otherwise stated in these terms and conditions, in the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
  7. The Game shall be governed by English law. Disputes arising in connection with the Game shall be subject to the exclusive jurisdiction of the English courts. Mandatory provisions of local law may also apply.
